Terms of Service

1. Parties and Scope

These Terms of Service form an agreement between Webesso and any individual or legal entity using services through webesso.com ("you" or "the Customer"). By using the Platform, you agree to these terms. All purchases are processed by Paddle.com Market Limited ("Paddle"), who acts as the Merchant of Record, meaning Paddle is the reseller and seller of record for all transactions.

2. Service Description

Webesso provides domain registration, automated content creation, website building, hosting, and publishing services. All steps are automated; technical delays may occasionally occur.

3. Paddle as Merchant of Record

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. All payments for Webesso services are processed by Paddle (paddle.com), who acts as the Merchant of Record. This means: • Paddle is the legal seller of the service. Your purchase is made from Paddle, not directly from Webesso. • All invoices are issued by Paddle. • Sales tax (VAT, GST, etc.) is calculated, collected, and remitted by Paddle based on your location. • Payment processing, billing, and transaction support are handled by Paddle. • By completing a purchase, you agree to Paddle's Buyer Terms (paddle.com/legal/buyer-terms). Webesso is the supplier and provider of the service itself (website creation, hosting, domain management, and technical support).

4. Orders and Payment

  • Payments are processed securely via Paddle, who handles all invoicing and tax obligations as Merchant of Record.
  • Monthly plans auto-renew each month. Annual plans auto-renew each year.
  • You will receive a renewal reminder from Paddle before each billing cycle where required by law.
  • You can manage your subscription and payment details through the Paddle buyer portal (accessible via your receipt email) or through your Webesso panel.
  • After a domain is purchased, the domain registrar's own refund policy applies separately.

5. Refund and Cancellation Policy

Since Paddle is the Merchant of Record, all refunds and cancellations are governed by Paddle's Refund Policy (paddle.com/legal/refund-policy) and Paddle's Buyer Terms (paddle.com/legal/buyer-terms). Key points: • Statutory withdrawal rights: If you are in the EU/EEA/UK/Turkey, you have a 14-day statutory right to withdraw from your purchase. Other countries may have different withdrawal periods as detailed in Paddle's Refund Policy. • Subscription cancellation: You can cancel your subscription at any time. Cancellation takes effect at the end of the current billing period; you will not be charged again after that. • Technical failure: If your website cannot be delivered due to a technical issue on our side, Webesso will instruct Paddle to issue a full refund. • Domain fees: Domain registration fees are governed by the registrar's refund policy and are generally non-refundable after 24 hours. • To request a refund, use the link in your Paddle receipt email, visit paddle.net, or contact us at support@webesso.com and we will coordinate with Paddle on your behalf. Refunds are typically processed within 5-10 business days to your original payment method.

6. Domain Ownership

All rights to the domain registered by Webesso belong to you. Webesso only manages the domain within the scope of service operations (DNS configuration, SSL, etc.). You may transfer your domain away at any time - either by pushing it to another NameSilo account or by initiating a standard ICANN transfer to a different registrar using an EPP authorization code.

7. Content Responsibility

Content is produced automatically. You are responsible for reviewing published content and updating it via the admin panel as needed. Publishing illegal, misleading, or copyright-infringing content is prohibited.

8. Service Interruptions

While we target 99.9% uptime, brief interruptions may occur due to maintenance, updates, or unforeseen technical issues. Webesso is not liable for indirect damages resulting from such interruptions.

9. Limitation of Liability

Webesso provides the Platform as-is. To the fullest extent permitted by law, Webesso shall not be liable for any indirect, incidental, or consequential damages arising from use of the service. Our total liability is limited to the fees you have paid in the 12 months preceding the event giving rise to the claim. Nothing in these terms limits liability for fraud, gross negligence, or any liability that cannot be excluded by law.

10. Changes

Webesso reserves the right to update these terms. Material changes will be notified via email at least 30 days in advance. Continued use of the service after the effective date of changes constitutes acceptance. The current version is always available on this page.

11. Governing Law

This agreement is governed by Turkish law. Kocaeli courts have exclusive jurisdiction over any disputes. For disputes related to payment and billing, Paddle's Buyer Terms apply, which are governed by English law.
